readMedia, Inc. (“readMedia”) is committed to providing its online users with services and information in an efficient and secure manner. This privacy policy explains what personal information is collected on readmedia.com and (the “Site”) from users of readMedia’s various online services, how that information is used and what measures readMedia takes to safeguard its users’ privacy.
What personal information is collected on the Sites? There is no general registration requirement for users of the Sites. Instead, we only collect information as needed to provide you with a particular service, such as Newsmaker or Hometown Newsmaker. Depending on the service you register for, we may collect some or all of the following information: name, e-mail address, street address, telephone and facsimile numbers, employer company profile, client profile, beat (for media users) and categories of interest.
How does readMedia use the information collected on the Sites? Information about individual users collected on the Sites is used for internal business purposes, including customizing services, contacting members regarding submissions, and responding to requests for information. On occasion, readMedia or one of its members or affiliates may also use this information to inform you of news, service upgrades or new services or products that may be of particular interest to you.
readMedia tracks aggregate anonymous statistics regarding usage of the web site and provides this anonymous information to members, affiliates, advertisers and for other lawful purposes.
Does readMedia provide personal information collected on the Sites to third parties? readMedia does not sell, trade or rent personal information collected online and will not knowingly disclose any individual personal information to third parties except as follows:
1. In order to provide you with requested services, readMedia may provide contact or other necessary information to affiliated sites such as LocalNewsmakers.com. For example, if you register for the LocalNewsmakers.com, readMedia may provide your email address to that group in order to facilitate your receipt of relevant news and subscription information;
2. If you register to have press releases for a particular readMedia member’s company e-mailed to you or if you download materials associated with a member’s press release, the member company may be notified that you have utilized one of these services and provided with your e-mail address in order to follow-up and provide you with additional valuable information;
3. When disclosure is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with the rights (including property rights) or safety of other users or third parties or of readMedia; and
4. When readMedia reasonably believes that disclosure is required by law or to comply with legal process served on readMedia.

How can I change or update the information I provide at the Sites? For services such as readMedia’s press release distribution service where user profile information is collected and stored in order to provide you with requested services, readMedia offers you the opportunity to change or update your profile information at any time by visiting the “My Account” section of the Newsmaker or Hometown Newsmaker applications.
Do the Sites use cookies? Yes, however readMedia only uses cookies to facilitate functions at the Sites and does not record or store any information about your movements on the Internet outside the Sites. Please note that if you click on a link to a third-party Web site from one of the Sites, the linked-to site may have different policies and practices with regard to cookies and readMedia has no control over and is not responsible for such policies or practices. You should always consult the privacy policy governing any Web site you visit on the Internet for complete information about their policies and practices.
What measures does readMedia take to safeguard its online users’ privacy? Information you submit at a readMedia Web site upon registration for specific services is password-protected so that the only parties who have access to the information besides readMedia and its agents and affiliates are the member entity and its employees. In addition, individual employees of members will receive individual passwords when they log-on to submit press releases online, and information submitted for membership requests and credit card transactions is conducted using SSL (Secure Socket Layer) encryption. In order to protect the integrity of the password system, members should refrain from disclosing passwords and immediately change any passwords that may have been compromised. readMedia will never ask you for your password by e-mail, so members and their employees should not respond to unsolicited e-mail requests asking for password information even if such requests appear to be from readMedia.
Please be advised that no data transmission over the Internet is 100% secure. readMedia is committed to protecting users’ personal information, but cannot guarantee or warrant the security of this information when it is sent to or through the Sites. Transmission of such information is therefore at the risk of the user.
General.
a. readMedia reserves the right to make changes to this Privacy Policy at any time and for any reason by posting a notice on the Sites. Users are responsible for regularly reviewing the Privacy Policy. The most current version of the Privacy Policy can be reviewed by clicking on the “Privacy Policy” hypertext link located on the Sites. If you do not agree to the Privacy Policy or any changes or updates, your only remedy is not to use the applicable Site or Service and to cancel any accounts or subscriptions that you may have established to access our Services. Your continued use of the applicable Site or Service after a change or update has been made to the Privacy Policy will constitute your acceptance of such change or update.

c. The Privacy Policy is governed by the laws of the United States of America and the State of New York. You hereby irrevocably consent to the exclusive jurisdiction and venue of the federal courts sitting in Albany County, New York, unless no federal subject matter jurisdiction exists, in which case the parties consent to the exclusive jurisdiction and venue of the state courts sitting in Albany County, New York in all disputes arising out of or relating to the Sites or the use of the Services.
d. readMedia may assign this Privacy Policy, in whole or in part, at any time.
e. readMedia’s performance of the Privacy Policy is subject to existing laws and legal process, and nothing contained in these Terms of Service is in derogation of readMedia’s right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the Services or information provided to or gathered by readMedia with respect to such use.
f. If any part of the Privacy Policy is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms of Service shall continue in effect.
g. The Privacy Policy, including the documents expressly incorporated by reference and any separate terms of use/service on any readMedia Site, constitutes the entire agreement between you and readMedia with respect to the content hereof and such agreements supersede all prior or contemporaneous communications, whether electronic, oral or written, between you and readMedia with respect to the readMedia Sites and Services. You represent that you have not relied on any such communications in choosing to accept these Terms of Service.
h. A printed version of the Privacy Policy and of any notices given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to the Privacy Policy to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
i. The express waiver by readMedia of any provision, condition or requirement of the Privacy Policy shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement. Notwithstanding anything else in the Privacy Policy, no default, delay or failure to perform on the part of readMedia shall be considered a breach of the Privacy Policy if such default, delay or failure to perform is shown to be due to causes beyond the reasonable control of readMedia.
j. All notices given by you or required under the Privacy Policy shall be in writing and addressed to: P.O. Box 1262, Albany, NY 12201, Attn: General Counsel. readMedia may give notice to you by means of a general notice on the readMedia Sites or Services, electronic mail to your e-mail address on record in readMedia’s Account information, or by written communication sent by first class mail, postage prepaid, or overnight courier to your address on record in readMedia’s Account information.
